After proving that a product was defective, a plaintiff must prove that the manufacturer knew about the defect and still sold the product. Again, it is the plaintiff who must prove beyond reasonable doubt that a product is defective. The plaintiff can use many ways to prove this claim, including testimony. For example, if the plaintiff has taken a device from another person who has used the device without causing any harm to himself or herself, the plaintiff can use this testimony to prove that the device was defective. If a plaintiff wants to prove that a product was defective, but he/she does not want to go to court, then a judge can award monetary damages in a Personal Injury case.
There are several ways a person can prove a product is defective. Some methods include but are not limited to, testing the device to determine whether it will work in a person's hand, the way it should and whether or not a person can hold it without injuring his/herself. The plaintiff's attorney can also help with this process by testing the product. to see if the product can be used in a way it was designed.
An individual can file a Personal Injury lawsuit against a company that is selling a defective product without having to pay thousands of dollars in lawyer's fees. Most people can handle this process on their own, but others may want to hire an attorney to help them. If you believe that a product was defective, you should consult with an attorney as soon as possible to protect your rights.
